Terms of use

The short version
faceoff is free to use. Don’t upload anything you don’t have the right to share, or anything unlawful or nasty. Your images stay yours - we only host them so your poll works. Polls expire and get deleted. We run the service with care but can’t promise it will never break. That’s the spirit of it; the detail is below.
1. Who we are
faceoff is operated by Digitopia Design Ltd, a company registered in England and Wales (company number 12037302), registered office 124 City Road, London EC1V 2NX. “We”, “us” and “our” mean Digitopia Design Ltd. You can contact us at hello@digitopiadesign.com.
2. What faceoff is
faceoff lets you upload options (currently images), share a link, and let people you choose to share it with vote on them. By creating a poll or casting a vote, you agree to these terms. If you don’t agree, don’t use the service.
You must be 16 or over to use faceoff. If you’re under 18, make sure a parent or guardian is happy with you using it.
3. Your content
You keep all rights to the images and text you upload. By uploading, you give us a limited licence to store, process, resize and display that content for the sole purpose of running your poll - including showing it to your voters and in the link-preview card generated when the poll is shared. That licence ends when your content is deleted.
You’re responsible for what you upload. Only upload content you own or have permission to use, and don’t upload anything that:
- infringes someone else’s copyright, trade marks or other rights
- contains personal information about someone else without their consent
- is unlawful, defamatory, obscene, hateful, or sexualises or endangers children in any way
- contains malware or attempts to interfere with the service
We don’t pre-screen uploads, but we can remove content or close polls that we reasonably believe break these rules, without notice. If it’s serious, we may report it to the relevant authorities.
4. Voting
Votes are anonymous unless a voter chooses to add their name. Voting is for humans making honest choices - don’t script, automate or manipulate votes. We use basic technical measures (such as rate limits and duplicate-vote checks) to keep results fair, and we may void votes or polls we reasonably believe are manipulated.
Results reflect the opinions of whoever voted. They’re a fun, useful steer - not professional advice, and we’re not responsible for decisions you make based on them.
5. Polls expire
faceoff is for decisions, not archives. Polls close 30 days after they are created, or sooner if their creator closes them. Poll content, including uploaded images and votes, is permanently deleted 30 days after a poll closes. Save anything you want to keep before then. We may also delete content sooner where these terms are broken.
6. Privacy
How we handle personal data - including voter names, creator email addresses and the technical data used to keep voting fair - is covered in our privacy page, which forms part of these terms.
7. The service
faceoff is currently provided free of charge. We work to keep it available and reliable, but it’s provided “as is” - we don’t guarantee it will be uninterrupted, error-free, or that content will never be lost. We may change, suspend or withdraw features (or the whole service) at any time. If we ever introduce paid features, they’ll come with their own clearly stated terms.
8. Fair use
Don’t abuse the service - that includes bulk poll creation, using faceoff to spam people, probing or attacking the infrastructure, or using it for anything unlawful. We can suspend or block access for misuse.
9. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be excluded under the law of England and Wales.
Beyond that: faceoff is a free service, and to the maximum extent the law allows, we’re not liable for any loss of profits, data, business or goodwill, or for indirect or consequential loss, arising from your use of it. Where liability can’t be excluded, it’s limited to £100. Nothing in these terms affects your statutory rights as a consumer.
10. Changes to these terms
We may update these terms from time to time - for example when we add features. The “last updated” date at the top will change, and continued use after an update means you accept the revised terms. If a change is significant and we hold your email address, we’ll make reasonable efforts to let you know.
11. General
If any part of these terms turns out to be unenforceable, the rest still applies. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction - though if you live in Scotland or Northern Ireland, you can also bring proceedings there.
